Welcome to Bansi. These Terms of Service ("Terms") govern your access to and use of the Bansi platform and services ("Service") operated by Writesonic, Inc. ("Writesonic," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

Bansi is an AI-powered video editing platform that uses artificial intelligence and machine learning technologies to assist users in editing video content. The Service includes:

  • Automated video editing and enhancement features
  • AI-powered scene detection and content analysis
  • Audio enhancement and processing
  • Caption and transcript generation
  • Export and rendering capabilities
  • Cloud storage for projects and media

2. Account Registration and Security

2.1 Eligibility

You must be at least 16 years old to use the Service. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2.2 Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You must provide accurate, current, and complete information during registration
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized access or security breach

2.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or Writesonic.

3. Content Ownership and Rights

3.1 Your Content

You retain all ownership rights to the original content ("User Content") you upload to the Service, including videos, images, audio files, and other media. By uploading User Content, you represent and warrant that:

  • You own or have the necessary rights to the User Content
  • Your User Content does not infringe any third-party intellectual property rights
  • You have obtained all necessary consents from individuals appearing in your content

3.2 AI-Assisted Output

When you use our Service to edit or enhance your User Content, the resulting output ("Output") is considered a derivative work of your User Content. Subject to these Terms and your compliance with them:

  • Commercial Use: You may use Output for commercial purposes, including monetization on platforms like YouTube, social media, or other distribution channels
  • Ownership: You own the Output to the extent permitted by applicable law. Note that under current U.S. copyright law, purely AI-generated content without human creative input may not be eligible for copyright protection
  • Human Contribution: We recommend applying your own creative judgment to AI suggestions—selecting, arranging, and modifying outputs—to establish protectable human authorship

3.3 License to Writesonic

By uploading User Content, you grant Writesonic a limited, non-exclusive, royalty-free license to:

  • Process, store, and transmit your User Content as necessary to provide the Service
  • Create derivative works (edited outputs) as you direct
  • Display previews and thumbnails within your account interface

This license terminates when you delete your User Content or close your account, except for backup copies that may be retained for a limited period per our data retention policy.

3.4 No Training Without Consent

We do not use your User Content to train our AI models unless you explicitly opt-in to such use. If you choose to participate in model improvement programs, you will be presented with separate terms and can withdraw consent at any time.

4. Acceptable Use Policy

You agree not to use the Service to create, upload, or distribute content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringes on intellectual property rights, privacy rights, or publicity rights of others
  • Contains sexually explicit material involving minors or non-consensual content
  • Promotes violence, discrimination, or hatred against individuals or groups
  • Creates deceptive deepfakes or synthetic media intended to mislead viewers about its authenticity
  • Spreads misinformation or disinformation
  • Impersonates any person or entity without authorization
  • Violates any applicable law, regulation, or third-party rights

4.1 Prohibited Technical Activities

You may not:

  • Attempt to gain unauthorized access to the Service or its systems
  • Use automated means (bots, scrapers) to access the Service without permission
  • Reverse engineer, decompile, or attempt to extract the source code of our AI models
  • Interfere with or disrupt the Service or servers connected to the Service
  • Circumvent any technological measures designed to protect the Service
  • Resell, sublicense, or provide access to the Service without authorization

5. Subscription and Payment

5.1 Pricing and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • Prices are subject to change with 30 days' notice to existing subscribers
  • All fees are non-refundable except as required by law or as stated in our refund policy

5.2 Free Trials

We may offer free trials at our discretion. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until then.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its design, features, AI models, algorithms, software, text, graphics, logos, and trademarks, is owned by Writesonic and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features without written permission.

6.2 Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use and incorporate such Feedback into our products and services without any obligation to you.

7. AI-Specific Terms

7.1 Nature of AI Services

Our AI-powered features are tools designed to assist your creative process. You understand that:

  • AI outputs are generated based on patterns learned from training data and may not always meet your expectations
  • AI suggestions are starting points—you should review and refine all outputs before use
  • AI technology is continuously evolving, and results may vary between sessions
  • We do not guarantee that AI-generated content is free from errors, biases, or inaccuracies

7.2 Your Responsibility

You are solely responsible for:

  • Reviewing and verifying all AI-generated outputs before publishing or distributing
  • Ensuring outputs comply with applicable laws and do not infringe third-party rights
  • Disclosing AI involvement in content creation where required by law or platform policies
  • Any consequences arising from your use of AI-generated content

8. Third-Party Services

The Service may integrate with or contain links to third-party services, including cloud storage providers, export destinations, and AI processing services. Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, privacy practices, or availability of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate
  • The Service will meet your specific requirements or expectations
  • Any AI-generated content will be suitable for your intended purpose

User Content Disclaimer: You are solely responsible for all video content you upload to or produce using the Service. We make no warranties or representations regarding any User Content or Output, including its accuracy, legality, non-infringement, or fitness for any particular purpose. Any use of videos created through the Service is entirely at your own risk and discretion.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRITESONIC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER DIRECT OR INDIRECT, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Writesonic, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration, except for disputes that qualify for small claims court. The arbitration shall take place in San Francisco, California, unless the parties agree otherwise.

12.3 Class Action Waiver

You agree to resolve disputes with us on an individual basis and waive the right to participate in class actions or class-wide arbitration.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. For significant changes, we will provide at least 30 days' notice via email or in-app notification. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Writesonic regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.
